A CMPR team led by John Dawson in California and Larry Brocchini in New York successfully defeated a motion for partial summary judgment against an Italian winery in the Supreme Court of the State of New York.

In LIDIA SALES ASSOCIATES, INC. vs. AZIENDA VINICOLA CASTELFEDER DI GIOVANETT GUNTHER & CO. SAS et al., Index No. 616544/2025, the winery was sued for alleged breaches of contract and violations of NY Labor Law regarding commissions purportedly earned by a company who introduced the winery to an importer in the U.S. CMPR’s opposition papers compelled the plaintiff to withdraw three of its claimed breaches prior to the hearing on the plaintiff’s motion for summary judgment. Ruling from the bench at oral argument, Judge C. Stephen Hackeling found that plaintiff had failed to sustain its burden with respect to the remaining claims that were the subject of the motion.
John Dawson, head of the firm’s Food & Beverage Group, has an excellent track record in defeating motions for summary judgment against wineries in state and federal courts in California and New York.
